New Parole in Place process starts on August 19 to help eligible families stay together in the US

Starting August 19, 2024, USCIS is launching Form I-131F, the new Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens.

The new process will consider on a case-by-case basis, requests for certain noncitizen spouses and stepchildren of U.S. citizens who have been continuously physically present without admission or parole in the United States for 10 years or more; have no disqualifying criminal convictions; and do not pose a threat to national security and public safety to be eligible for adjustment of status to US Lawful Permanent Residence status.

Key Details:

  • Availability: Form I-131F will be available online beginning August 19, 2024. 
  • Filing requirements: Applicants will need to complete the form online with their biographic information and provide evidence such as their relative’s status as a US citizen, evidence of their qualifying relationship and evidence of their presence in the US without any criminal convictions. 
  • Online Submission: Applicants can work with a preparer to assist them in filing the application.
