USCIS released a policy memo last month on the EB-5 Program, including
the Immigrant Investor Program, providing guidance to all USCIS employees
regarding adjudication of EB-5 petitions and applications. The EB-5 Program
was created to promote the investment of capital by immigrants into new
commercial enterprises in the US in order to create new jobs for U.S.
workers. The policy memo clarifies the correct standard of proof in assessing
the evidence. The policy memo also expands on the individual elements
for the EB-5 Program, providing definitions and examples of certain terms,
as well as citations to recent cases and regulations.
